Rules for Organizations & Facilities:

Max Holding TimeInfectious waste must not be stored for more than 7 days without refrigeration at or below 45°F. When refrigerated at or below 45°F, the combined period of storage and transportation must not exceed 45 days, unless specifically approved by the New Mexico Environment Department.
Labeling RequirementsAll containers used for storing or transporting infectious waste must be clearly labeled with the biohazard symbol and the words "Infectious Waste" or "Biohazard".
Container StandardsGeneral infectious waste should be contained in plastic bags inside rigid containers. The bags must meet the testing requirements specified by 40 CFR 173.197 and be red or orange.
Who Can Haul WasteOnly transporters permitted by the NMED are authorized to haul infectious waste. These transporters must comply with both state regulations and applicable federal Department of Transportation (DOT) hazardous materials regulations.
Documentation RequiredOperating records retained for up to 3 years
