Rules for Organizations & Facilities:
Requirement | Rule |

Max Holding Time | Infectious waste must not be stored for more than 7 days without refrigeration at or below 45°F. When refrigerated at or below 45°F, the combined period of storage and transportation must not exceed 45 days, unless specifically approved by the New Mexico Environment Department. |
Labeling Requirements | All containers used for storing or transporting infectious waste must be clearly labeled with the biohazard symbol and the words "Infectious Waste" or "Biohazard". |
Container Standards | General infectious waste should be contained in plastic bags inside rigid containers. The bags must meet the testing requirements specified by 40 CFR 173.197 and be red or orange. |
Who Can Haul Waste | Only transporters permitted by the NMED are authorized to haul infectious waste. These transporters must comply with both state regulations and applicable federal Department of Transportation (DOT) hazardous materials regulations. |
